Curriculum vitae

Mr. J. Uzman (Jerfi) studeerde Nederlands recht, in het bijzonder staats- en bestuursrecht, aan de Universiteit Leiden. Hij studeerde in 2005 af op een scriptie, getiteld “Droit de l’homme et droit du citoyen”, over de ruimte voor politieke meningsuiting van vreemdelingen in het Nederlandse recht. Deze scriptie werd in 2006 door de jury van de Max van der Stoel Mensenrechtenprijs gewaardeerd met een eervolle vermelding. Tijdens zijn studie werkte hij als studerend juridisch medewerker bij Ernst & Young Belastingadviseurs in Den Haag, en als student-assistent bij Juridisch PAO en het vak Moot Court (departement Metajuridica). Direct na zijn afstuderen trad Jerfi Uzman in dienst van de Leidse afdeling Staats- en bestuursrecht, aanvankelijk als onderwijs- en onderzoeksmedewerker en per 1 september 2007 als promovendus op het gebied van het (vergelijkend) staatsrecht.

Proefschrift

Jerfi schrijft een proefschrift met de voorlopige titel Effective legal protection of fundamental rights and judicial review of statutory acts. Centraal in dit onderzoek staat de vraag hoe de Nederlandse rechter om dient te gaan met schendingen van fundamentele (verdrags)rechten wanneer een effectieve rechtsbescherming daartegen politieke keuzes vergt. Onderzocht wordt hoe de constitutionele rechters van de Verenigde Staten, Canada, het Verenigd Koninkrijk en Duitsland met dit spanningsveld omgaan, en of daaruit lessen te trekken zijn voor een eventueel Nederlands model. Het onderzoek vindt plaats onder begeleiding van prof.mr. T. (Tom) Barkhuysen (promotor) en dr.mr. M.L. (Michiel) van Emmerik.   Meer informatie over het onderzoek is te vinden op:

Mr. J. (Jerfi) Uzman graduated from Leiden University (LL.M in Law) in the field of Constitutional and Administrative Law in 2005. His Master’s thesis on the scope of the freedom of political expression of migrants was awarded an honourable distinction by the Jury of the Max van der Stoel Human Rights Award in 2006. Following graduation, he was appointed a junior instructor (onderwijs- en onderzoeksmedewerker) at the department of Public Law, section Constitutional and Administrative Law of the same university. He teaches both the introductory and the second year course on Constitutional and Administrative Law and coordinated the Masters course on legislative studies in 2006 and 2007.

Dissertation and research

He is currently working on a PhD-thesis provisionally called Effective legal protection of fundamental rights and judicial review of statutory acts. It concerns the relationship between courts and political institutions from a comparative constitutional perspective. When statutory legislation is incompatible with international fundamental rights provisions, courts occasionally refuse to provide a remedy. In those cases courts (afraid of entering political territory) assume that remedies should be provided for by the elected legislature. One of the two main questions of the research is how this practice relates to the principle of effective legal protection of fundamental rights. Jerfi moreover questions the possibilities for courts to increase their willingness to provide remedies without marginalising the role of elected legislatures. He tries to find out what different roles courts and parliament play in protecting fundamental rights and whether those roles are in fact complementary or conflicting. To this end Jerfi undertakes a comparative study of remedies in the framework of judicial review in Germany, the UK, the US and Canada. A number of concepts such as the political question doctrine and the notion of constitutional dialogue are part of this study. The research project is supervised by professor T.
